Who is Responsible for the Costs of a Civil Action? (optional material)
If the civil suit is successful—that is, if it is determined that the plaintiff's rights were violated by the defendant, then the legal action was necessitated by that violation of rights, and its cost should therefore be paid by the defendant. On the other hand, if no such violation is determined, then the legal costs are properly borne by the plaintiff, who necessitated those costs by bringing suit.
